US Court Mandates Release of Kilmar Abrego Garcia from ICE Detention

A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was held in federal custody.

In her decision, the court noted that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Case

The legal proceedings involve disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.

The court, who was hearing his petition to removal in a Maryland district court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This decision shifts his supervision to the jurisdiction handling his criminal case.
